This website is operated by 1515 Industries LLC d/b/a Ghost Constrictors (“Ghost Constrictors,” “Seller,” “we,” “us,” or “our”).
These Terms of Service and Terms of Sale (“Terms”) govern your use of ghostconstrictors.com and any purchase from Ghost Constrictors.
By accessing our website, placing an order, submitting payment or a deposit, or electronically accepting these Terms, you (“Buyer,” “Customer,” or “you”) agree to these Terms and all policies incorporated herein.
1. ELIGIBILITY & LEGAL OWNERSHIP
By purchasing a live animal, Buyer represents that Buyer is at least 18 years old or otherwise legally authorized to enter into the transaction and is legally permitted to possess the animal at its intended destination.
Buyer is solely responsible for determining and complying with applicable federal, state, county, municipal, landlord, HOA, or other ownership restrictions.
Buyer represents that all billing, shipping, identity, email, telephone, and other information supplied to Ghost Constrictors is accurate.
Ghost Constrictors may refuse or cancel an order because of suspected fraud, legal restrictions, animal-welfare concerns, payment issues, inability to verify Buyer information, or other reasonable business or safety concerns.
2. PRODUCTS & LIVE ANIMALS
Unless expressly stated otherwise, photographs on an individual animal listing depict the actual animal offered for sale.
Buyer is responsible for reviewing the entire product listing before purchase.
Live animals naturally change with age, growth, shedding, feeding, environment, and maturity. Exact future size, weight, coloration, contrast, pattern development, temperament, behavior, breeding performance, fertility, or market value is not guaranteed.
Photography, lighting, cameras, and electronic displays may cause colors or appearance to differ from the animal's appearance in person.
3. PRICING & ORDER ACCEPTANCE
Prices and availability may change without notice before purchase.
Ghost Constrictors may correct typographical, pricing, inventory, product-description, or other errors and may cancel an affected order when reasonably necessary. If Ghost Constrictors cancels a fully paid order because of our error before fulfillment, amounts paid for the canceled item will be refunded.
An order is not considered fully paid until all required funds have cleared.
4. PAYMENT VERIFICATION & FRAUD PREVENTION
Ghost Constrictors may require additional verification before processing or shipping an order.
We may request verification of identity, payment authorization, billing information, shipping information, telephone number, email address, or other information reasonably necessary to confirm the transaction.
Orders that cannot reasonably be verified may be canceled.
5. PAYMENT PLANS & DEPOSITS
Payment plans are offered solely at Ghost Constrictors' discretion.
Unless otherwise agreed in writing:

A minimum 20% non-refundable deposit is required to hold an animal.

Payment plans generally must be completed within 30–60 days.

Animals remain in Ghost Constrictors' possession until paid in full.

Failure to complete the payment plan by the agreed deadline may result in cancellation of the hold and release of the animal for resale.

Deposits and payments made toward a canceled or defaulted payment plan are non-refundable to the fullest extent permitted by applicable law.
Extensions or exceptions must be approved by Ghost Constrictors in writing.
6. FINAL SALES & CANCELLATIONS
ALL LIVE-ANIMAL SALES ARE FINAL.
Except for remedies expressly provided under these Terms or required by applicable law, live animals may not be returned, exchanged, or refunded because Buyer:

Changes their mind;

Experiences buyer's remorse;
-
Finds another animal they prefer;
-
Experiences financial hardship;
-
Cannot obtain approval from another person, landlord, HOA, or authority;
-
No longer wishes to own the animal;
-
Experiences normal feeding or behavioral changes;
-
Expected different temperament, adult appearance, size, coloration, breeding performance, or future value; or
-
Otherwise decides the animal is no longer wanted.
No live animal may be returned without prior written authorization from Ghost Constrictors.
Orders canceled by Buyer after purchase are not guaranteed a refund. Ghost Constrictors may, in its sole discretion, approve a cancellation, store credit, partial refund, or other accommodation.
If Ghost Constrictors voluntarily approves a cancellation after purchase, a cancellation/restocking fee of up to 50% of the order total may be deducted from any refund or credit to the extent permitted by applicable law.
This cancellation fee does not apply when Ghost Constrictors cancels an otherwise valid order solely because Ghost Constrictors cannot fulfill it.
7. SHIPPING
Live-animal shipping is governed by our Shipping & Live Arrival Policy, incorporated into these Terms by reference.
Live animals generally ship Tuesday for Wednesday arrival, weather and carrier conditions permitting.
Ghost Constrictors may delay shipment because of weather, temperatures, holidays, carrier conditions, animal condition, or other circumstances reasonably affecting animal welfare.
A safety-related shipping delay does not constitute non-delivery or breach.
8. TRANSFER OF RESPONSIBILITY
Responsibility for the animal's ongoing husbandry, environment, security, feeding, handling, and care transfers to Buyer when Buyer or Buyer's authorized recipient takes physical possession of the animal, subject only to the limited guarantees expressly provided in these Terms.
After possession transfers, Ghost Constrictors cannot control temperature, humidity, enclosure conditions, feeding, handling, exposure to other animals, pathogens, injury, or other environmental and husbandry factors.
9. LIVE ARRIVAL
Live Arrival protection applies only when Buyer complies with the Shipping & Live Arrival Policy.
A suspected DOA must be reported within one hour of pickup or receipt with the documentation required by that policy.
For an approved Live Arrival claim, Ghost Constrictors' sole remedy shall be, at Ghost Constrictors' election, replacement with a reasonably comparable animal or store credit equal to the purchase price paid for the affected animal, except where applicable law requires another remedy.
Shipping costs and incidental expenses are not included unless required by law.
10. LIMITED HEALTH GUARANTEE
Ghost Constrictors represents that, to the best of our knowledge, animals are in acceptable health and condition for sale and transport when they leave our care.
A suspected health condition must be reported within 48 hours of Buyer's receipt.
Buyer must provide information reasonably requested by Ghost Constrictors, which may include photographs, video, enclosure photographs, temperature/humidity readings, husbandry information, feeding information, and veterinary documentation.
Veterinary Care & Expenses
Buyer is responsible for obtaining appropriate veterinary care when necessary. To the fullest extent permitted by applicable law, veterinary examinations, diagnostic testing, medications, treatment, procedures, transportation, and other veterinary or medical expenses incurred after Buyer takes possession are Buyer's responsibility and are not reimbursable by Ghost Constrictors.
Requiring or requesting veterinary documentation as part of evaluating a guarantee claim does not constitute an agreement by Ghost Constrictors to pay or reimburse the cost of obtaining that documentation or any related veterinary care. Nothing in this provision limits any right or remedy that applicable law does not permit the parties to waive.
The Health Guarantee does not cover illness, injury, or death caused or materially contributed to by improper husbandry, temperature, humidity, dehydration, feeding, substrate, handling, trauma, escape, other animals, pathogens, failure to quarantine, or another condition arising after possession transfers.
For a valid Health Guarantee claim, Ghost Constrictors' sole remedy shall be, at our election, replacement or store credit up to the amount paid for the affected animal, except where applicable law requires otherwise.
11. FEEDING
Feeding information is provided to the best of our knowledge.
Ball pythons may temporarily refuse food following relocation because of acclimation, shedding, season, breeding behavior, prey preference, husbandry, or other normal circumstances.
Temporary refusal to feed does not, by itself, establish that an animal was unhealthy or improperly represented.
12. SEX
Ghost Constrictors makes reasonable good-faith efforts to accurately determine sex.
Any claimed sex discrepancy must be reported within seven calendar days of receipt.
Ghost Constrictors may require reasonable independent verification.
For a confirmed and timely sex discrepancy, Ghost Constrictors' sole remedy shall be, at our election, store credit reflecting the reasonable difference in value attributable to the sex discrepancy at the time of original purchase or replacement with a reasonably comparable animal, except where applicable law requires otherwise.
A sex discrepancy does not entitle Buyer to consequential damages, breeding losses, lost profits, hypothetical offspring value, or future market-value losses.
13. GENETICS
Ghost Constrictors makes reasonable good-faith efforts to identify genetics based upon information reasonably available at the time of sale, including phenotype, parentage, lineage, breeding records, prior breeding results, and third-party testing.
Buyer acknowledges that visual identification of ball python genetics is not infallible.
Visually Identified Genetics
Unless expressly identified as third-party tested or proven through breeding, dominant and incomplete-dominant genes constitute Ghost Constrictors' good-faith visual identification.
VISUALLY IDENTIFIED DOMINANT AND INCOMPLETE-DOMINANT GENETICS ARE NOT GUARANTEED.
Buyer accepts the risk that such a trait may later prove absent, incorrectly identified, or accompanied by another unidentified trait.
A discrepancy involving a visually identified, non-guaranteed trait does not entitle Buyer to rescission, return, refund, damages, or other compensation except where required by law.
Possible Heterozygous Genetics
“Possible het,” “50% het,” “66% het,” and similar probability-based designations describe probability only and do not represent that the animal actually carries the trait.
Possible heterozygous genetics are not guaranteed.
14. THIRD-PARTY GENETIC & SHED TESTING
Ghost Constrictors may use independent third-party laboratories to test shed samples or other biological material.
When an animal or trait is described as “shed tested,” “genetically tested,” “lab tested,” “verified by testing,” “tested positive,” or substantially similar terminology, the statement means that an independent third-party testing provider reported that result to Ghost Constrictors.
GHOST CONSTRICTORS WARRANTS ONLY THAT WE ACCURATELY COMMUNICATED THE TEST RESULT PROVIDED TO US. GHOST CONSTRICTORS DOES NOT INDEPENDENTLY WARRANT OR GUARANTEE THE SCIENTIFIC ACCURACY, RELIABILITY, METHODOLOGY, INTERPRETATION, OR CORRECTNESS OF A THIRD-PARTY TEST RESULT.
Ghost Constrictors does not control the laboratory's equipment, personnel, procedures, sample processing, sample identification, methodology, interpretation, database, quality control, or reporting.
To the fullest extent permitted by law, Ghost Constrictors assumes no liability for an inaccurate, false-positive, false-negative, contaminated, switched, misidentified, misinterpreted, incomplete, or otherwise erroneous result originating with an independent testing provider, provided Ghost Constrictors accurately communicated the result received and did not knowingly alter or misrepresent it.
If later testing or breeding indicates that the independent provider's result was incorrect, that laboratory error does not constitute a breach by Ghost Constrictors where Ghost Constrictors accurately communicated the result it received.
Claims concerning the scientific accuracy of third-party testing must be pursued with the testing provider and are subject to that provider's policies and remedies.
Ghost Constrictors does not guarantee that the testing provider will provide compensation, refund, retesting, replacement, or another remedy.
When reasonably available, Ghost Constrictors may provide documentation identifying the provider and result originally reported to us.
15. BREEDING & INVESTMENT DISCLAIMER
Ghost Constrictors does not guarantee fertility, breeding performance, successful reproduction, egg production, hatch rates, offspring, future proof of an unverified trait, future market value, resale value, project success, profitability, or investment return.
Statements concerning possible breeding outcomes, genetic combinations, future offspring, or market value are informational and not financial guarantees.
Buyer assumes the biological and financial risks associated with breeding, resale, and investment.
16. CUSTOMER ASSISTANCE
Ghost Constrictors may provide reasonable post-purchase husbandry guidance as a courtesy while the business remains operational and as availability permits.
Such assistance is not a lifetime service, continuing warranty, veterinary service, or contractual obligation to provide indefinite support.
Urgent medical concerns should be directed to a qualified reptile veterinarian.
17. TRANSACTION DOCUMENTATION
Ghost Constrictors may retain records relating to transactions, including:

Order and payment records;

Checkout acceptance;

Billing and shipping information;

Fraud-screening information;
-
Product listings;
-
Product photographs;
-
Pre-shipment photographs/videos;
-
Packing records;
-
Shipping labels;
-
Tracking and delivery/pickup records;

Emails;
-
Text messages;
-
Social-media communications;
-
Customer photographs/videos;
-
Veterinary documentation;
-
Testing documentation; and
-
The version of applicable policies accepted at purchase.
These records may be used to administer orders, investigate claims, protect our legal interests, and respond to payment disputes as permitted by law.
18. CHARGEBACKS & PAYMENT DISPUTES
Ghost Constrictors provides procedures for legitimate order, shipping, health, and product concerns and encourages Buyer to contact us promptly so that we have a reasonable opportunity to investigate.
Nothing in these Terms eliminates any payment-dispute right that cannot legally be waived.
If Buyer initiates a payment dispute concerning a transaction Ghost Constrictors believes was properly authorized or fulfilled, Ghost Constrictors may contest the dispute and provide relevant evidence to payment processors, card networks, financial institutions, issuing banks, acquiring banks, or other authorized entities.
Evidence may include checkout acceptance, payment records, AVS/CVV results, fraud screening, available IP/device information, product listings, photographs, packing records, tracking, delivery/pickup confirmation, and customer communications.
Communications in which Buyer acknowledges ordering, receiving, possessing, photographing, feeding, handling, discussing, caring for, or breeding the animal may be retained and submitted as evidence relevant to the transaction.
19. EXCLUSIVE REMEDIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE REMEDIES EXPRESSLY PROVIDED IN THESE TERMS ARE BUYER'S SOLE AND EXCLUSIVE REMEDIES FOR CLAIMS COVERED BY THE APPLICABLE LIMITED GUARANTEE.
Where Ghost Constrictors is permitted to select between replacement, store credit, or another stated remedy, that selection belongs to Ghost Constrictors unless applicable law requires otherwise.
20. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, GHOST CONSTRICTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, CONSEQUENTIAL, OR SPECULATIVE DAMAGES ARISING FROM OR RELATING TO AN ANIMAL OR TRANSACTION.
Excluded damages include, without limitation, lost profits, lost revenue, lost breeding seasons, breeding opportunities, expected or hypothetical offspring, reduced offspring value, future animal value, market-value changes, project expenses, husbandry expenses, veterinary expenses, diagnostic expenses, medications, treatment costs, testing expenses, transportation expenses, or other animal-care expenses, shipping expenses not expressly covered, or testing expenses not previously authorized.
TO THE FULLEST EXTENT PERMITTED BY LAW, GHOST CONSTRICTORS' AGGREGATE LIABILITY ARISING FROM A TRANSACTION SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO GHOST CONSTRICTORS FOR THE PARTICULAR ITEM OR ANIMAL GIVING RISE TO THE CLAIM.
Nothing herein limits liability that applicable law prohibits us from limiting.
21. DISCLAIMER OF IMPLIED WARRANTIES
EXCEPT FOR THE EXPRESS LIMITED GUARANTEES SPECIFICALLY PROVIDED IN THESE TERMS AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PRODUCTS AND ANIMALS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.”
GHOST CONSTRICTORS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE EXPRESS LIMITED GUARANTEES SPECIFICALLY PROVIDED IN THESE TERMS.
22. THIRD-PARTY SERVICES
Our website may use or link to services operated by third parties, including payment processors, carriers, testing providers, financing services, social-media platforms, and other providers.
Ghost Constrictors does not control independent third parties and is not responsible for their acts, omissions, policies, services, or errors except to the extent liability cannot legally be excluded.
23. WEBSITE USE & PROHIBITED CONDUCT
Buyer/user may not use this website for unlawful purposes; transmit malicious software; attempt unauthorized access; scrape or misuse site content; submit fraudulent or misleading information; violate intellectual-property rights; impersonate another person; or interfere with website security or operation.
We may refuse or terminate access for prohibited conduct.
24. INTELLECTUAL PROPERTY & USER SUBMISSIONS
Website content, branding, photography, graphics, text, and other original materials are owned by or licensed to Ghost Constrictors and may not be reproduced or commercially exploited without permission.
By voluntarily submitting a review, photograph, testimonial, or other content to Ghost Constrictors or tagging Ghost Constrictors in content intended for public interaction, Buyer grants Ghost Constrictors a non-exclusive license to reproduce and display that content for legitimate business and marketing purposes, subject to applicable law.
25. INDEMNIFICATION
To the fullest extent permitted by applicable law, Buyer agrees to indemnify and hold harmless 1515 Industries LLC d/b/a Ghost Constrictors and its owners, officers, employees, contractors, and agents from third-party claims arising from Buyer's violation of these Terms, violation of applicable law, or acts occurring after possession of the animal transfers to Buyer, except to the extent caused by liability that cannot legally be excluded.
26. ENTIRE AGREEMENT
These Terms, the applicable order confirmation, Refund & Cancellation Policy, Shipping & Live Arrival Policy, Privacy Policy, and any written terms expressly incorporated into the transaction constitute the agreement concerning the transaction.
Specific written representations regarding an individual animal remain subject to the warranty, genetics, testing, and remedy limitations contained herein.
27. NO ORAL MODIFICATION
Casual conversations, social-media comments, livestreams, direct messages, telephone discussions, or other informal communications do not modify these Terms unless Ghost Constrictors expressly agrees to the modification in writing.
28. GOVERNING LAW & VENUE
To the fullest extent permitted by applicable law, these Terms and transactions with Ghost Constrictors shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Any legal action arising from these Terms or a transaction shall, to the fullest extent permitted by law, be brought in an appropriate state court located in Clinch County, Georgia, or an appropriate federal court having jurisdiction in Georgia.
Nothing herein deprives a consumer of a protection or forum that applicable law does not permit the parties to waive.
29. SEVERABILITY
If a provision is determined invalid or unenforceable, it shall be enforced to the maximum extent permitted or severed as necessary, without affecting the remaining provisions.
30. WAIVER
Failure by Ghost Constrictors to enforce a provision on one occasion does not waive our right to enforce it subsequently.
31. CHANGES TO THESE TERMS
Ghost Constrictors may update these Terms prospectively.
The version applicable to a purchase is the version presented or otherwise applicable when the transaction was completed, except where the parties subsequently agree otherwise.
32. ELECTRONIC ACCEPTANCE
Electronic acceptance constitutes agreement to these Terms.
By checking the applicable agreement box and completing checkout, Buyer acknowledges having had an opportunity to review these Terms and the incorporated policies before purchasing.
